KNOXVILLE, Tenn. (WVLT) -- Day five of the trial of the alleged accessory to a deadly carjacking begins with Eric DeWayne Boyd's attorney asking for a mistrial.
Boyd's attorney Phil Lomonaco says the prosecution's reference to a car Boyd had allegedly borrowed being at the scene on Chipman Street was an attempt to insinuate to the jury that Boyd was involved in the carjacking.
Lomonaco says the reference to an alleged uncharged crime was not proper and should lead to a mistrial.
Judge Tom Varlan denied that motion, meaning this trial moves forward.
Boyd's lawyer says yesterday's testimony about the brutality of the murders of Channon Christian, 21, and Christopher Newsom, 23, is unnecessary and an attempt to inflame the jury.
Prosecutors say they did not create the facts and they must prove Eric Boyd knew that Lemaricus Davidson committed a crime leading to serious bodily injury or death.
Testimony began today with the police fingerprint technician who says he found Davidson's print on items inside Channon Christian's silver SUV, the day after the murders.
The key witness this morning was Kassie Suttles, a friend of Davidson's girlfriend, Daphne Sutton.
Boyd's lawyer says Sutton should have been charged as an accessory, but she never was.
Suttles says she took Daphne to Davidson's home, briefly on Sunday, when prosecutors say Christian was being held there.
Stuttles testified that Davidson was driven to her apartment Sunday in what turned out to be Channon's silver SUV and Davidson wound up spending the night with Daphne Sutton in the spare bedroom.
