Knoxville (WVLT) - The man accused of killing a former West High School student, who was allegedly having an affair with his wife, appeared in court Tuesday.

Thirty-one-year old Jason McLean's case is now headed to the grand jury.

He's charged with first degree murder in connection with the death of 18-year-old Sean Powell.

Volunteer TV's Kim Bedford was there for the preliminary hearing today where a bond was set for McLean.

The state requested a $500,000 to $1 million bond and Jason McLean's attorney asked for $100,000.

Judge Andrew Jackson set McLean's bond at $150,000, agreeing with the defense, that the 31-year-old has no prior criminal record or arrests, and does not consider him a flight risk.

Earlier, the state called KPD investigator Andrew Boatman to the stand.

Boatman says Erin McLean would not give a statement or answer any questions about what happened in front of her house March 10th.

Boatman says Jason McLean told him Sean Powell and his wife had been having an affair for about three months.

McLean told Boatman he bought a 30-30 caliber rifle two weeks before the shooting that he planned to use on himself some time.

Boatman says McLean told him everything was a blur after he asked Sean to leave his house on March tenth.

"Sean came to his house on this night and he asked Sean not to come into his house. He said that Sean came in anyway and that when he went inside, his wife started yelling at him for yelling at Sean," says Andrew Boatman, KPD investigator.

We'll know even more once a trial date is set.
