Knoxville (WVLT) A Tennessee State Trooper accused of an inappropriate on-duty incident earlier this month is being allowed to resign instead of being fired.

Late last week, the state began proceedings to fire Trooper James Randy Moss.

Moss is accused of receiving a sex act from adult film actress Barbie Cummings from Knoxville, after he disposed of painkillers he allegedly found in her car during a traffic stop.

Cummings, whose real neame is Justis Richert, then posted pictures and the story on her blog.

Today the Tennessee Highway Patrol announced they would honor moss' resignation in lieu of his termination.
