Christian-Newsom Case: Eric Boyd's Attorney Off the Case

Knoxville (WVLT) A major development in the case against the only man charged federally in connection with the Channon Christian-Christopher Newsom murder case.

Eric Boyd will need a new attorney before the case moves forward.

Boyd's attorney Richard Gaines made a motion this morning to be taken off the case, citing irreconcilible differences between him and his client.

That motion was accepted by US Magistrate H. Bruce Guyton.

According to the Federal Court Clerk's office in Knoxville, Boyd will now have to be appointed new attorney before the case can move forward.

A status hearing is now set for October 19th.

Federal prosecutors were expected to ask a judge today to delay the start of the trial.

At issue, authenticity of Eric Boyd's cell phone records.

According to documents filed Monday in federal court, prosecutors say they and the defense indicated that a stipulation would be reached about the authenticity of the records prior to trial.

But Monday, federal prosecutors says they received word from Boyd's defense, that stipulation could not be reached.

Prosecutors say that in order to authenticate the records they will need a representative of the cell phone company to testify.

That, they say, will take a three week notice.

Boyd has pleaded plea not guilty to charges he helped Lemaricus Davidson hide from police, although he knew Davidson had committed a carjacking that resulted in the death of Christian and Newsom.

The indictment also alleges he did not report the crime to authorities.

Boyd could face 15 years in prison when he stands trial.
