KNOXVILLE, Tenn. (AP) -- An attorney who was never paid for representing a Roane County man in a murder case wants control of the family's estate.

The Knoxville News Sentinel reported Cleveland, Tenn., attorney Jim Logan filed a Probate Court petition, asking that he be given control of the estate of the father of Rocky Joe Houston and Leon Houston. Clyde Houston died in March.

The state failed to win murder convictions against the brothers in the 2006 fatal shooting of Mike Brown and Roane County Deputy Bill Jones.

Logan says the family pledged part of their land for him to represent Leon Houston in two trials, but never paid him.

Leon Houston claims his trial wasn't legitimate and Logan wasn't his lawyer.

The brothers are now facing federal weapons charges.
