SEVIERVILLE, Tenn. (WVLT) -- A Sevierville judge voided last November's election legalizing liquor by the drink in Pigeon Forge on Thursday.
Sevier County Chancellor Telford Fogerty ordered a new election take place no sooner than 45 days from now, but no later than 60 days from now. He did not say whether businesses already serving liquor must stop.
The third-party group Forging Ahead, which was allowed to join the case last week, argued for upholding the results of the election. Its attorneys wanted the 289 votes in question divided proportionally, so they could certify the vote.
Meanwhile, lawyers for Concerned Churches contended that no one knows how those 289 people wanted to vote and if an election has more illegal votes than the margin of error, then a new election is in order.
