Family of woman killed by fallen tree sues homeowners

KNOXVILLE, Tenn. (WVLT) -- The husband of a woman killed when a tree fell onto her car last December filed sued the owners of the home where the tree once stood. Tiffany Raley died after the tree crushed her car as she drove down Colonial Drive.
Her husband, Shannon, is seeking five million dollars in compensatory damages and any punitive damages the court deems appropriate. He claims Tiffany's death is the sole result of gross negligence on the part of the homeowners, Brett and Barbara Johnson.
He said that by October 2011, following several complaints by neighbors and government inspections, the Johnsons either knew or should have known that the tree was dangerous. He said the tree was leaning heavily towards the street and had a crack on the bottom.
