Huntingdon, Tenn. (AP) -- A prosecutor in West Tennessee says the state accepted a plea bargain in an infant rape case to preserve lifetime sex offender status against the defendant.
Twenty-year-old Jonathan Wayne Goodrum was charged with raping the one-day-old daughter of his former fiancé.
He was scheduled to go on trial Thursday in Huntingdon, but District Attorney General Hansel McCadams says flaws were found in the evidence.
There was a conflict concerning who was around the baby and when.
Witness statements and surveillance video from McKenzie Regional Hospital didn't coincide.
McCadams says medical information conflicted on whether a rape took place.
He proposed the plea deal, rather than risk Goodrum being acquitted.
Under its terms, Goodrum pleaded guilty to attempt to commit rape of a child, for which he received a ten-year term with all but one year suspended. Since he has been in jail for the eleven months since his arrest, he's scheduled for release next month.
But McCadams says the plea deal also requires Goodrum to register as a sex offender, submit to DNA analysis, be under lifetime court supervision and have no contact with the victim.
He also must continue to see a psychiatrist, at his own expense, until the court allows him to stop.
The baby's mother also entered a guilty plea Thursday to a misdemeanor charge, failing to report child sexual abuse.
She was given 60 days in jail, but is free, having been confined for longer than that until trial.
