Check the history books, TN debating the Constitution

KNOXVILLE, Tenn. (WVLT) --- Will they or won't they? Washington is debating a ban on certain types of guns but while America waits to see what happens, some politicians in Tennessee are already pulling the trigger on a new law.

State Bill 250 would exempt our state from any federal gun ban. But is it legal?

There's an honest debate in Nashville over the most important document in American history.

Does the constitution say states can pick and choose which laws they want to follow?

Does it allow Tennessee to say 'thanks but no thanks' to a federal ban on guns?

It might be a complicated debate but according to the UT School of Law the answer is not.

"Short answer is no. Short answer is just no." So says Professor David Wolitz. "Its very hard to see how the governmnt could function if every state had an opt out option for laws."

But Senator Stacy Campfield, a cosponsor of the bill disagrees. "There is some of that but the 10th amendment says there are certain powers left up to the states." The Senator told us.

History is not on his side. But the Senate is taking this very seriously. As Senator Doug Overbey says, "I think the General Assembly wants to protect constitutional rights but we don't want to do something that in itself is unconstitutional."

The debate is now heading to the Attorney General's office, who will make a decision on one of the Country's oldest artifacts.
