Judge denies convicted murderer's request for new trial

A Sevier County judge has ruled a convicted murder won

Police say Leah V. Arvil, 18, was murdered on Tuesday, Nov. 17, 2009.

SEVIERVILLE, Tenn. (WVLT) – A Sevier County judge has ruled a convicted murder won't be given a new trial.

Jacob A Stanton, convicted for the November, 2009 death of Leah V. Avril, had filed a motion for a new trial following his conviction. Monday, a Sevier County judge heard those arguments and denied the request.

Deputies say the 18-year-old woman was murdered at a Sevier County apartment, and investigators says she was killed by the man who lived at the Murrell Meadows Dr. apartment where she was found dead, according to a SCSO news release.

Officers responding to a shooting call found Leah V. Avril, of Robert Henderson Rd in Sevierville, lying on a bed with a gunshot wound to her chest, the release said.

Deputies arrested Jacob A. Stanton, 21, and charged him with second degree murder.

Last week, Attorneys for Jacob Stanton provided amended and additional grounds in his motion for a new trial yesterday. Stanton's legal representation first filed a motion for a new trial in September.

According to the filing, law enforcement resumed interrogation after Stanton's attorney, Lee Wheatley, asked them to not speak to Stanton.
Stanton also requested a new sentencing hearing "because the current sentence is based upon the court's reliance on inapplicable law."

Stanton was convicted in April for 2nd degree murder.
