NASHVILLE, Tenn. (WVLT) -- Three people in Claiborne Co. are accused of selling prescription drugs they bought with TennCare funds, the Office of the Inspector General announced on Monday. Working with the Claiborne Co. Sheriff's Office, the OIG arrested Crystal King, Patricia Smith, and David L. Johnson.
The 49 year-old Johnson was charged with TennCare fraud, three counts of sale of a Schedule III controlled substance, and three counts of delivery of a Schedule III controlled substance. The OIG said the New Tazewell man used TennCare to by Hydrocodone and was going to sell some of it.
The 32 year-old King faces charges of TennCare fraud, sale of a Schedule II controlled substance, and delivery of a Schedule II controlled substance. The OIG said the Clairfield woman used TennCare to buy Oxycodone and planned to sell a portion of it.
The 49 yea-old Smith was charged with TennCare Fraud, two counts of sale of a Schedule IV controlled substance, sale of a Schedule III controlled substance, two counts of delivery of Schedule IV controlled substance, and delivery of a Schedule III controlled substance. The New Tazewell woman is accused of using TennCare to get the pain medication LorTab with the intent of selling a portion.
The OIG noted TennCare fraud is a Class E felony carrying a sentence of up to two years in prison; sale or delivery of a Schedule III controlled substance is a Class D felony, punishable by two to four years in prison; and, sale or delivery of a Schedule II controlled substance is a Class C felony, punishable by three to six years in prison. District Attorney General William P. Phillips is prosecuting.
