RALEIGH, N.C. (AP) -- The father of a woman killed at her Raleigh apartment must pay only a fraction of the $170,000 in court costs accrued by the apartment complex he accused of negligence.
In court filings made public Tuesday, the North Carolina Court of Appeals upheld a lower court's decision to order Terry Bennett of Rocky Mount, Va., to pay about $1,700 to the Bridgeport Apartments in Raleigh.
Bennett's daughter, 23-year-old Stephanie Bennett, was raped and strangled in her apartment in May 2002. Her father said in a lawsuit that the environment at the complex was unsafe.
The civil case was dismissed after three days of testimony in January 2007.
The suspect in the case, Drew Planten, was arrested in October 2005. He was being held in Central Prison in Raleigh when he committed suicide in January 2006.
