Federal judge dismisses Nuclear Fuel Services suit

ERWIN, Tenn. (AP) -- A federal judge has dismissed a class-action lawsuit against Nuclear Fuel Services claiming that negligent operation of the plant led to death, injury and environmental damage.

The Johnson City Press reports U.S. District Judge Ronnie Greer dismissed the suit in a Dec. 21 ruling.

NFS President Joe Henry said in a news release that the company is pleased with the ruling. He said NFS is committed to operating in a way that protects employees, the public and the environment.

The lawsuit claimed that residents had developed various forms of cancer because of hazardous releases at NFS.

The Nuclear Regulatory Commission recently announced a cancer risk study to be conducted at the Erwin facility, which processes nuclear fuel for the U.S. Navy.

Plaintiff Park Overall said they likely will appeal.
