MEMPHIS, Tenn. (WVLT/AP) -- Two witnesses who were ordered arrested so they would testify have cooperated with a Memphis judge's insistence that they comply.
Jumicah Atkins and Johnathan Smith, both adults, admitted their gang affiliations at a transfer hearing in Juvenile Court on Wednesday.
They testified the defendant fired from a ditch in the shooting that killed 18-year-old bystander Devail Lewis outside a community center Sept. 19, 2012.
Atkins said he earlier saw a gang member bully the defendant, who was then 17, by taking away the teen's gun and pointing it at him. Atkins said he convinced the bully to return the weapon, but said the defendant wouldn't forgive the humiliation.
The judge sent the murder charge to adult court where now- 18-year-old Darnavius Wayne will be prosecuted.
